Aqui vão 5 diferenças principais para te ajudar a identificar cada um.
Segurança: enquanto o loteamento é aberto e conectado as vias públicas, podendo haver ou não uma associação de moradores para questões ligadas à segurança, no condomínio fechado por sua vez os moradores pagam para custear sistemas de segurança com: portaria 24 horas, entrada e saída controlada etc.
Administração: no loteamento pode ou não haver uma associação de moradores, caso exista, existe a possibilidade de negociação de uma concessão para com a prefeitura para ser possível fechar a área, mas a área contínua de posse da prefeitura. Já no caso do condomínio fechado, eles são administrados normalmente ou por síndico eleito pelos moradores ou por uma empresa especializada contratada para tal.
Legislação: todos dois empreendimentos estão amparados por leis entretanto por leis diferentes, sendo que o loteamento é amparado pela lei 6.766/79 já o condomínio, a lei de referência é a 4.591/64
Manutenção: nos condomínios fechados, existe a obrigatoriedade de pagamento de uma taxa referente as manutenções e administração do condomínio, enquanto o loteamento pode ou não cobrar uma taxa referente a manutenção a depender da associação.
Propriedade: quando você adquire um terreno em condomínio fechado, você adquire uma parte específica da área total, com isso adquire direitos de utilização das áreas comuns. Já no loteamento, o cliente somente está comprando o seu lote, ou seja o espaço definido. s áreas comuns se tornam públicas após aprovação do projeto pela prefeitura.
